Privacy Policies
Disclosure:
Fast Data Technology will never willfully disclose identifiable information about our clients to any third party without first receiving our clients permission.
Fast Data Technology will not willfully share the information from our clients' without their consent. The only exception to this policy is when we are required to do so by a legal statute, a law enforcement agency, or regulatory authority. This will usually be done only after we receive a court order or subpoena that requires us to release information.
In certain cases, an emergency request from a verifiable law enforcement agency may be honored prior to receiving a court order or subpoena. We will make every reasonable effort to notify our clients as soon as possible if we receive a request for the release of information so that our clients can have the opportunity to pursue any legal rights and remedies they may have under the law.
Under certain circumstances, a court order or law may prohibit us from notifying our clients of a request for information. Examples of this include cases in which fraud and/or criminal activity is suspected. In these cases, we will make every effort to notify our client, at the earliest possible time permissible under the law.
If a client grants permission, the information may also be shared with partners in the Fast Data Technology Network. The information will be shared in accordance with the specific purpose for which the client grants permission. For example, if a client expresses an interest in having a web experience or receiving a certain type of information, Fast Data Technology will provide its approved partners with only that data as is necessary to provide the client the desired level of personalization or the information requested. We may also use information we obtain from our clients' use in certain portions of our site to analyze what our clients like and don't like about Fast Data Technology's current offerings, so that we can provide more valuable services.
Fast Data Technology reserves the right to send a one-time registration confirmation email when you become a Fast Data Technology client. Fast Data Technology also occasionally sends outbound administrative email communications to ensure that our clients are aware of significant updates or changes in our products and services. We encourage you to allow us to send this information to you so that you will always be aware of the latest information about our products and services. Fast Data Technology respects your right not to receive any email that you have not specifically agreed to receive and, in furtherance of this right, has put policies in place that allow our clients to control the delivery of these messages, or to prevent delivery if that is your preference.
In some cases Fast Data Technology must send administrative emails to our clients to alert them to specific changes that may impact their ability to use a service they have previously signed up for, regardless of their email contact opt-in status. Examples of these alert messages would include notification of an impending closing of an account that is believed to be abandoned or that has been used in violation of our Terms of Use, problems with your account, or bugs or problems that Fast Data Technology is encountering that may impact the effective performance of our products or continuing operation of our site. We also reserve the right to contact you if compelled to do so as part of a legal proceeding. Fast Data Technology is retaining these rights because in some limited cases we may need to exercise the right to contact you as a matter of law or regarding matters, which will be important to you. First and foremost, we are accountable to you, our clients. You are the reason that we are in business and we take our responsibility to manage your information and protect your privacy very seriously. However, we have also taken the additional step subjecting our Privacy Policies and Practices to external organizations that have a mission to build trust and confidence in the Internet by promoting privacy, trust, and advocacy on the part of the consumer.
Acceptable Use Policy:
In using our products and services or visiting our Web Sites, we require that you agree to and abide by the terms and conditions of our Acceptable Use Policy ("Policy"). If you have already accepted and agreed to one of our services agreements, then you are covered by that agreement which incorporates the terms and conditions of this Policy. Otherwise, our Acceptable Use Policy applies when visiting our Site. Abusive Uses:
You agree to use Fast Data Technology products and services only for lawful purposes. Fast Data Technology reserves the right to terminate any customer account or agreement for which (i) a Fast Data Technology hosted domain is found to be pointing or otherwise directing traffic to any material in violation of any US or State statute or regulation and/or (ii) the Service(s) is used to point to web sites or locations that create, transmit, distribute or store material that:
* Violates US trademark, copyright, trade secret or other intellectual property law;
* Violates the privacy, publicity or personal rights of others;
* Violates US export control laws;
* Impairs the privacy of communications;
* May be threatening, abusive or hateful; or
* Encourages conduct that would constitute a criminal offense or give rise to a civil liability.
Additionally, any misuse of Fast Data Technology products and services or resources that disrupts the normal use of our system is strictly prohibited.
Abusive uses, including facilitating, aiding or encouraging such uses, may lead to termination of the customer account or agreement.
Any attempts to penetrate Fast Data Technology security will result in the immediate termination of the customer account and agreement without notice, as well as notification of appropriate law-enforcement agencies.
Unacceptable Uses:
The following violations of "netiquette", which we actively encourage our customers and users to report to us, are grounds for immediate suspension of Service(s) pending our own investigation and will result in termination of the account(s) and agreement(s) if the investigation determines, in our sole judgment, that the customer has originated or is any way responsible for such activities:
Content:
You are entirely responsible for all content or information you directly or indirectly deliver to or pass through Fast Data Technology's Web Site. Fast Data Technology exercises no control over, and accepts no responsibility for such content or information, including, without limitation, content provided on any third party Web sites linked to the Fast Data Technology Web Site. Fast Data Technology provides any such links as navigation tools for informational purposes only, and not as an endorsement. Fast Data Technology does not adopt, nor warrant the accuracy of or the content of any linked Web site and undertakes no responsibility to update such content.
Consequences of unacceptable use:
Fast Data Technology reserves the right to suspend or terminate access to the Service(s) upon notice to you by Fast Data Technology of a violation of this Policy. Failure to promptly correct such violations and comply with this Policy may result in termination of your account(s) with no refunds offered.
Indirect or attempted violations of this Policy, and actual or attempted violations by a third party on your behalf, shall be considered violations of this Policy by you. It is a violation of this Policy to use the products and services of another provider for the purposes of facilitating any of the unacceptable use activities described in this Policy if such use of another provider's service could reasonably be expected to affect the Service(s).
Indemnity:
You agree to indemnify and hold harmless Fast Data Technology, its officers, directors, employees, and agents from any losses, damages, costs, or expenses resulting from any third party claim or allegation ("Claim") arising out of a or relating to any Claim which, if true, would constitute a violation of this Policy.
A suspension of service means that you will not be able to access or use any service(s) we are providing to you until our investigation of an activity in violation of this Policy is completed. We recognize that excessive delay during investigations may be detrimental and we will use all reasonable efforts to pursue any such investigations.
Customers and Site visitors acknowledge and agree that Fast Data Technology may amend this policy at any time by posting the amended terms on the ultradns.com Web Site and that such amendments shall be effective for all use of the Fast Data Technology Web Sites, and are binding upon the customer or visitor upon such posting.
